These terms of use (“Terms”) represent a legally binding agreement between you and Baiyabasa Realty Services Limited (“Company,” “We,” “Baiyabasa,” or “Us”) regarding your use of our website www.baiyabasa.com (the “Site”), any related domains, and any services offered or deemed to be offered by the Company, including but not limited to content delivery through the Site or any internet-connected device (“Service”). By using the Site, you are entering into a contract with Baiyabasa Realty Services Limited, the owner of the platform. These Terms, along with our policies, form your binding obligations to Baiyabasa. Therefore, it’s crucial that you familiarize yourself with these terms before using the platform.

Terms of Use

When you use any of our services through the platform, such as product or seller reviews, you are subject to the rules, guidelines, policies, and conditions specific to those services. These are integrated into these Terms and are considered part of this agreement.

Amendment of Terms

Baiyabasa reserves the right to amend or modify these terms and conditions at any time, with changes becoming effective immediately upon posting on the Site. You are encouraged to review these modifications regularly. Continued use of the Site following any changes will constitute your acceptance of the revised terms. Baiyabasa also reserves the right to suspend site operations for maintenance, content updates, or technical upgrades without prior notice.

Unless specified otherwise, the capitalized terms shall have the following meanings:

  • “Agreement”: The completed application form, attachments, and these terms and conditions.

  • “Date of Commencement”: The date when the user’s application for service is accepted.
  • “Date of Termination”: The expiry date as mentioned in the termination notice or letter.
  • “Baiyabasa.com”: The Company’s internet website or mobile application.
  • “My Subscriptions”: The page containing information and descriptions of the services provided to the user by the Company.
  • “Registration Data”: The database of all information provided by the user during registration.
  • “User”: Any individual or corporate subscriber, advertiser, visitor, or browser of the services, including their successors and assignees.

Term Period

These Terms will continue to apply as long as you access the Site and use the services provided by the Company.

Services Offered

The Company offers a variety of internet-based services through its platform, which include:

  • Posting user profiles or listings for property sales or rentals.
  • Finding properties through Baiyabasa.com and its associated links.
  • Placing print advertisements in any of the Company’s group publications.
  • Posting advertisements on Baiyabasa.com.
  • Sending promotional messages via email and SMS.

Services can be purchased through various payment methods, and their use is subject to additional policies, including subscription fees, payment, refund, and cancellation policies.

User Eligibility

By using the Site, you represent that you are at least 18 years of age and are competent to enter into a binding contract. Individuals under 18 may use the Site only with the involvement and guidance of a parent or legal guardian. You agree to register and provide complete and accurate information, including your name, age, email, residential address, and contact number.

PG Listings & Platform

  1. Users are solely responsible for verifying the accuracy and genuineness of any PG listing. Baiyabasa is not liable for any fraudulent or misleading listings.
  2. Packages purchased for regular and PG listings on the current platform can be used until a new PG platform is launched. After that, remaining packages can only be used for non-PG listings on the current platform.
  3. PG listings will be visible on the current platform and migrated to the new platform post-launch until the listing’s expiry.
  4. Users who buy a PG package must obtain a No Objection Certificate (NOC) from PG owners or operators.
  5. PG owners or operators must complete KYC as per Baiyabasa policy.

Fee Structure

  • Subscription fees are as stated on the “My Subscriptions” page or as updated by the Company.
  • Fees are payable from the Date of Commencement.
  • Users accessing the Site for property purchases are exempt from subscription fees unless Company policy changes.

Payment and Refund Guidelines

  • A 50% administrative fee is charged on all orders, with the remaining 50% refunded on a pro-rata basis in case of cancellation, subject to usage. Refunds may take 4 to 6 weeks for processing.
  • Subscription fees are payable as per the invoice issued by the Company.
  • Any disputes over fees should not delay payment, but any excess amount paid will be refunded if the dispute is resolved in the user’s favor.
  • Late payments may incur interest on the outstanding amount.
  • Payments made via the iOS app are non-refundable.

Charge Reversal Policy

  • Payment for services is required in full and in advance.
  • Refunds are at the sole discretion of the Company.
  • The Company may set off any payment made by the user against other amounts owed to the Company under different agreements or services.
  • The Company is not responsible for delays in refunds due to third-party payment processing issues.

Governing Law and Jurisdiction

The terms are subject to the laws of India. Any legal action or proceeding related to your use of our services will be subject to the exclusive jurisdiction of the courts in New Delhi.

Service Cancellation

  • The Company reserves the right to cancel or stop any content from being published on its Site. Cancellation charges are outlined in the cancellation and refund policy.
  • There is no cancellation or refund for platinum listing packages purchased via online payment options (except by cheque or demand draft). Cancellation requests for cheque/demand draft orders can only be made before the payment is processed by the Company.

Security Measures

  • Transactions on the Site are secure, with user information encrypted to prevent unauthorized disclosure. Credit and debit card information is not stored by the Company but is processed directly by the authorized payment gateway.
  • Users are responsible for maintaining the confidentiality of their user identification and passwords and must notify the Company immediately if they suspect any unauthorized use.
  • The Company reserves the right to change or reassign user identification codes at its discretion.
The Company is not liable for any unauthorized transactions resulting from the theft or loss of user identification or passwords.

Obligations and Representations of User/Subscriber

  1. Accurate Registration Data: Users must provide accurate and complete registration information when initially applying for services.
  2. Data Verification: Users acknowledge that any data entered on the platform will undergo a mandatory verification process by the Company.
  3. Licenses and Approvals: Users are responsible for obtaining any licenses, permits, consents, approvals, and intellectual property or other rights required for using the service, at their own cost.
  4. Compliance with Instructions: Users must comply with all notices or instructions provided by the Company to enable proper use of the services.
  5. Responsibility for Taxes and Costs: Users are responsible for all applicable taxes and any costs incurred while using the site’s services.
  6. Information Management: Users are solely responsible for all information retrieved, stored, and transmitted by them.
  7. Confidentiality of Credentials: Users must keep their passwords and user identification confidential and ensure that their account activities remain secure.
  8. Account Activity Responsibility: Users are responsible for all activities conducted under their display name and password.
  9. Unauthorized Access Notification: Users must notify the Company immediately if there is any unauthorized use or breach of their account and ensure they log out at the end of each session.
  10. Prompt Notification of Security Breaches: Users must promptly inform the Company of any security breaches or unauthorized use of their account.
  11. Payment of Subscription Fees: Users must make prompt payments for subscription fees as they become due.
  12. Age Requirement: Users must confirm that they are over 18 years old and legally competent to enter into a contract.
  13. Equipment Configuration: Users are responsible for setting up or configuring their equipment to access the services.
  14. Advertisement Reflection: Users acknowledge that online advertisements placed on Baiyabasa.com will be reflected after 48 hours and agree to this processing time.
  15. Data Usage Consent: Users agree that any data entered may be saved, used, and commercially exploited by Baiyabasa Realty Services Limited as deemed appropriate.
  16. Intellectual Property Rights: Users grant the Company a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable right to exercise all copyright and publicity rights over the material or user data displayed in their listings.
  17. Indemnity for Third-Party Claims: Users will indemnify Baiyabasa Realty Services Limited for any claims made by third parties resulting from information posted on the site by the user.
  18. Liability for Wrong Data: Users are solely responsible for any incorrect data entered on the site and may face legal actions from third parties. The Company will endeavor to remove such data within a reasonable time after verification.
  19. Indemnification for Wrong Data: Users agree to indemnify and keep the Company indemnified for any false or wrong data entered on the site, and guarantee that all data entered is true and correct.

Restricted Activities

  1. Restricted Access: Users must not allow anyone other than authorized persons named in the application to use the service.
  2. No Resale or Assignment: Users must not resell or assign their rights or obligations under these Terms & Conditions, nor make any unauthorized commercial use of the service.
  3. Service Usage Restriction: Users must use the service only for the purpose for which it was subscribed.
  4. Compliance with Laws: Users must comply with all applicable laws in India relating to the services.
  5. Data Handling: Users must not print, download, duplicate, or otherwise copy, delete, vary, or amend any data or personal information posted by other users on the site, except their own.
  6. Lawful Use: Users must not use the service for any unlawful or fraudulent purpose.
  7. Offensive Content: The service must not be used to send or receive any messages that are offensive on moral, religious, racial, political, or other grounds, or that are abusive, indecent, obscene, defamatory, or menacing.
  8. No Resale of Listings: Users must not sell their listings to any third party. The services are intended for the user who paid for the subscription.
  9. Content Restrictions: Users must not post any information or content on the site that causes threats, harassment, annoyance, anxiety, or any other inconvenience.
  10. Intellectual Property Rights: Users must not infringe upon the intellectual property rights of others or retain information in any computer system with such intent.
  11. Use of Information: Users must not use someone else’s information except as necessary to complete transactions in which they are involved.
  12. Site Security: Users must not violate or attempt to violate the security of the site or any connected networks, nor gain unauthorized access to private information or accounts.
  13. Malware Prohibition: Users must not introduce, post, or transmit any information or software that contains a virus, worm, or other harmful components.
  14. Company Rights on Violations: If a user violates these terms, the Company may delete related materials and suspend or deactivate the user’s access to the site and related services. The Company may also seek legal remedies to recover losses and damages caused by such violations.
  15. Blacklist and Liquidated Damages: In the event of a breach, the Company may blacklist the user and forfeit any unutilized subscription fees as liquidated damages.
  16. Lawful Use of Services: Users must avail services only for lawful purposes. Any unauthorized use of material protected by intellectual property rights, or material that is obscene, defamatory, libelous, or in violation of privacy, is prohibited.
  17. Anti-Spam Policy: The Company opposes spam and prohibits all forms of it, including the use of another internet service to send or post spam to drive visitors to sites hosted on Baiyabasa.com.
  18. Automated Access Prohibited: Users must not use automated means like “deep-link”, “page-scrape”, or “robot” to access or monitor any part of the site.
  19. Unauthorized Access Prohibited: Users must not attempt to gain unauthorized access to any part of the platform or related systems.
  20. No Unsolicited Advertising: Users must not engage in unsolicited advertising or solicitation of services on the platform.
  21. Content Responsibility: Users are responsible for ensuring that content they post does not infringe on proprietary rights, contain libelous or unlawful information, or mislead others.

Termination Clause

  1. Either party may terminate this agreement with 30 days’ written notice. The company may waive or shorten this period at its discretion.
  2. The company may terminate this agreement immediately without notice if the user breaches any terms, if continuing the service is deemed not in the public interest, or if the user is declared bankrupt or enters into a compromise with creditors, without prejudice to any other rights.

Liabilities Post-Termination

  1. If the agreement is terminated as outlined in Clauses XIX or XX, the user remains liable for subscription fees until the termination date.
  2. All amounts owed to the company upon termination must be paid within 30 days of the termination date.

Suspension of Service

  1. If the user fails to pay any amounts due, the company may suspend the service, which may lead to termination. The user remains liable for all charges and fees incurred up to the suspension date.
  2. If the user subsequently pays the required amounts, the company may, at its discretion, reconnect the service under terms it deems appropriate.

Money-Back Policy

  1. If a user is dissatisfied with the responses received from a listing posted using the Money-Back Package, they can initiate a refund request by contacting the company through the feedback link, email, or customer care.
  2. To claim a refund, at least one property must have been posted using the package.
  3. The user will first be offered an extension of the listing duration for free to evaluate the responses again.
  4. If the user remains unsatisfied after the extension, the company will initiate a refund.
  5. Refunds can only be requested within the listing’s lifetime (60 days from posting).
  6. Refunds can only be initiated for the same Order ID and Customer Name as provided during order booking.
  7. Refunds for online payments will be processed after deducting payment gateway charges.
  8. Refunds will be processed within 30 business days of receiving and accepting all relevant documents.

Violation of Terms & Conditions

If the terms are violated, the company may take legal action, including immediate deletion of offending material, account cancellation, or exclusion of violators. The company will cooperate with investigations by relevant authorities without notifying the user. If necessary, the company may release user information to minimize liability.

Personal Data

Your submission of personal information through this site is governed by our Privacy Policy.

Errors and Omissions

Occasionally, there may be errors, inaccuracies, or omissions on the site or in the service, including in product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors and update or cancel orders if needed, even after an order has been placed. However, we are not obligated to update information on the site, except as required by law. The absence of a specified update date should not be taken to mean that all information has been modified or updated.

Liability Limits

  1. The User agrees that the Company and its affiliates, directors, officers, and employees are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including but not limited to damages for lost profits, data, or use. The User further agrees that the Company is not liable for damages resulting from service interruptions, whether justified or not.
  2. The Company is not responsible for shortages or non-fulfillment of services due to technical failures or malfunctions. Users agree not to claim damages for service deficiencies under any applicable law.
  3. The Company is not liable for any costs related to downloading fees, airtime, ISP connection costs, or other charges incurred by the User.
  4. The Company is not responsible for any malfunction or damage to mobile devices arising from the use of the Baiyabasa mobile application.

Compensation

The User agrees to indemnify and hold harmless the Company and its directors, employees, and agents from any claims arising from the advertisement or posting of property on the Site, including infringement of third-party rights or violations of applicable laws. The User further agrees to indemnify the Company from any liabilities or damages resulting from their use of Baiyabasa.

Notices

  1. All notifications will be considered delivered when sent: (a) to the User at the address provided on the Application Form; (b) to the Company at the address specified in writing for such purposes. However, invoices and payments should be directed to the Company’s Finance department, legal notices to the legal department, and all other communications to the account manager designated by the Company. Notice is regarded as given upon personal delivery and upon receipt of acknowledgment/written verification from an overnight courier.
  2. Grievance Redressal Mechanism: Any complaints, concerns, or reports of content violations or breaches of these terms should be promptly directed to the designated Grievance Officer via written communication or email at [email protected] or to (“Grievance Officer”).

Non-Exclusive Resolution

The termination or expiration of this Agreement, in full or in part, does not prevent either party from seeking other available remedies. Both parties remain responsible for any fees due under this Agreement up to the effective date of termination. Neither party will be liable to the other for any damages resulting solely from termination as allowed under this Agreement.

Waiver of Rights

The Company’s failure to exercise or enforce any right or provision of these Terms & Conditions does not constitute a waiver of that right or provision. If any provision is found invalid by a competent court, the parties agree that the court should aim to uphold the parties’ intentions as reflected in the provision, and the remaining provisions shall continue in full effect.

Complete Agreement

This Agreement represents the complete and exclusive agreement between the parties regarding the subject matter, superseding all prior agreements, documents, and communications. This Agreement may only be modified or any rights under it waived through a written document executed solely by the Company. The Company reserves the exclusive right to make changes or amendments.

Law and Jurisdiction

  1. There is no agency, partnership, joint venture, employer-employee, or franchiser-franchisee relationship between the Company and any User of the Service.
  2. The User agrees that any claim or cause of action related to the use of the Service or the Terms & Conditions must be filed within 30 days of the incident or be permanently barred.
  3. All information received from the user is provided in good faith and is believed to be true, correct, and in compliance with applicable laws.
  4. This Agreement and any disputes arising from the use of Baiyabasa.com are governed by Indian law, with the courts in Delhi, India, having exclusive jurisdiction.

Acknowledgment and Acceptance of Terms and Conditions

The terms and conditions outlined above constitute the entire agreement between the User and the Company, replacing all previous arrangements regarding the subject matter. By completing the registration process or checking the “I have read and accept the Terms of Use” box, the User agrees to be bound by all the terms and conditions outlined by the Company.

Privacy Statement

  2. The Company collects user information through various advertising campaigns, which users voluntarily provide. This information is stored in the Baiyabasa.com database and is used exclusively by the Company. Third-party advertising companies display ads on various internet sites to reach potential users. Any unauthorized use or sharing of information by third parties will result in appropriate legal action by the Company, including indemnification for third-party claims.

Legal Metrology Disclaimer

Users must indicate property area in standard units of measurement as per the Legal Metrology Act, 2009 (base unit: meter). The Company is not liable for any law infringement by users.

RERA Disclosure

Project developers, builders, and real estate agents must comply with RERA Act 2016 and obtain the necessary registration. They must disclose all required information on the Site. We do not guarantee compliance or registration under the Act. The Company is not liable for any claims related to inaccuracies on the Site. Users are advised to refer to respective RERA websites for complete information before making any decisions.

Rental Agreement Disclosure

  1. A “User” or “Tenant” refers to any individual or entity searching for rental property and submitting their details on the Company’s portal.
  2. The Company acts solely as a facilitator between the User/tenant and landlord and does not serve as an agent for either party. The transaction is conducted on a principal-to-principal basis.
  3. Users voluntarily provide confidential information at their own risk. The Company or its partners/vendors may contact the User for facilitating the rent agreement process. The use of this information is subject to the Company’s Privacy Policy.
  4. Users are responsible for seeking independent legal advice regarding the appropriate stamp duty for lease deeds/rent agreements. The Company does not provide legal opinions and is not responsible for any advice provided by third parties.
  5. The Company does not sell stamp papers but facilitates the transaction.
  6. The Company has not verified the property title or condition, and Users must conduct their own due diligence.
  7. Users and landlords are responsible for any tax or liability arising from their transaction and must indemnify the Company against any claims.
  8. The Company will not be held responsible for disputes between the User/tenant and landlord.
  9. Orders cannot be canceled or refunded. In rare cases where the service is not fulfilled, the Company will provide the best resolution possible, including a refund if necessary.

Home Loan Services

  1. By opting for Home Loan services, the User authorizes Baiyabasa (“Company”) and Financial Institutions to contact them.
  2. Loan approval and disbursement are at the discretion of financial institutions. The Company acts as a third-party facilitator and is not responsible for loan outcomes.
  3. The rates and terms displayed on the portal are indicative; actual terms depend on the financial institution’s assessment of the User’s profile.
  4. The Company does not guarantee loan approval or the quality of services provided by financial institutions.
  5. The Company does not collect any payments for home loan services from Users; payments should be made directly to the financial institution.
  6. The Company is not responsible for verifying the validity of information provided by Users and is not liable if the loan application is rejected.
  7. Users provide confidential information at their own risk, and the Company is not responsible for any misuse of this information by third parties.
  8. The Company may share User information with financial institutions and brokers to fulfill the User’s requirements.
  9. The Company retains a copy of User information, subject to its privacy policy.
  10. The Company will not mediate disputes between Users and financial institutions and is not responsible for any disputes.
  11. Information about financial institutions is gathered from public sources and is subject to change. Users must verify this information directly.
  12. Third-party offers displayed on the portal are for marketing purposes only, and the Company is not responsible for their accuracy or validity.
  13. Fulfillment services are available only in select cities and for certain User profiles and may be suspended or unavailable without notice.
  14. Home loans are subject to regulations by the Reserve Bank of India, which may change over time. The Company is not liable for any issues arising from changes in regulations.
  15. These terms and conditions apply to all types of home loans, including loans against property, balance transfers, and top-up loans.

PG Services

  1. Company Role: Baiyabasa Realty Services Limited (“Company”) serves as an online platform, facilitating connections between Users and PG Owners, but does not act as an agent for either party. All transactions are conducted directly between the User and the PG Owner.
  2. Stay Agreement: Users/Tenants must agree to stay in their selected PG for a minimum of 3 months.
  3. Confidentiality: Users voluntarily share personal information (e.g., name, email) at their own risk. The Company is not responsible for any misuse of this data by third parties and is not liable for any resulting issues.
  4. PG Quality: The Company does not guarantee the quality of the PG or the services provided by the PG Owner. Users should verify the PG through physical inspection and direct communication with the PG Owner.
  5. Rent Agreement: The Company does not mediate the terms of the rent agreement between the User and PG Owner.
  6. Property Verification: The Company has not verified the property title or condition. Users should conduct their own due diligence before proceeding.
  7. Disputes: The Company will not be a party in any disputes between Users and PG Owners. Users must indemnify the Company against any losses incurred due to such disputes.
  8. Service Issues: The Company is not liable for any issues with services provided by PG Owners, lawyers, or other service providers.
  9. Tax Liabilities: Users and PG Owners are responsible for any taxes or liabilities arising from their transaction, and the Company must be indemnified against any related losses.
  10. Booking Cancellations: The Company reserves the right to cancel bookings, with applicable cancellation charges as per the cancellation and refund policy.

  1. Company Role: Baiyabasa Realty Services Limited (“Company”) acts as a connector between Users and Service Providers offering tenant verification services, not as an agent for either party.
  2. Confidentiality: Users voluntarily share their personal information for tenant verification at their own risk. Users agree to be contacted by Service Providers via phone, email, or WhatsApp. The use of this information is governed by the Company’s Privacy Policy.
  3. Service Quality: The Company carefully selects Service Providers with strong industry reputations, but does not guarantee service quality. Users should resolve any issues directly with the Service Provider.
  4. Tenant Consent: The tenant’s consent is required for verification services, and it is not the Company’s responsibility to obtain this consent.
  5. No Character Verification: The Company does not verify or provide opinions on the tenant’s character or credibility.
  6. Disputes: The Company will not be a party in any disputes between Users and Service Providers. Users must indemnify the Company against any related claims or liabilities.
  7. Cancellation and Refund Policy: Users can receive a full refund if cancellation occurs before tenant details are shared with the Company and within 30 days of purchase. No refund is provided after tenant details are shared or beyond 30 days from purchase. In rare cases, the Company will assess service issues and provide the best possible resolution, which may include a refund.

Home Assistance

  1. Company Role: Baiyabasa Realty Services Limited (“Company”) connects Users with Service Providers for home services like pest control, cleaning, and sanitization, without acting as an agent for either party.
  2. Confidentiality: Users voluntarily share personal information with the Company and consent to be contacted by Service Providers. The information shared is subject to the Company’s Privacy Policy.
  3. Service Terms: Services are governed by the terms of the respective Service Providers, such as UrbanCompany, Nakoda DCS, and HiCare.
  4. Service Quality: The Company carefully selects Service Providers but does not guarantee service quality. Users should address any service quality issues directly with the Service Provider.
  5. Disputes: The Company will not be a party in any disputes between Users and Service Providers. Users must indemnify the Company against any related claims or liabilities.
  6. Cancellation and Refund Policy: Full refunds are available for cancellations made 24 hours or more before the scheduled service. A 50% refund is provided for cancellations made 4-24 hours prior to service. In cases of service delivery lapses, the Company will assess the situation and provide a suitable resolution, possibly including a refund.
  7. Rescheduling: Users can reschedule services once without a fee if done 12 hours or more before the scheduled time. Rescheduling within 4-12 hours may incur a fee. If the Service Provider fails to show up, Users are eligible for a full refund or rescheduling at no extra cost.

Property Evaluation

  1. Company Role: Baiyabasa Realty Services Limited (“Company”) connects Users with Service Providers for property inspection services, without acting as an agent for either party.
  2. Confidentiality: Users share personal information at their own risk. The Company’s use of this information is governed by its Privacy Policy.
  3. Service Quality: The Company selects reputable Service Providers but does not guarantee the quality of their services. Users should address any concerns directly with the Service Provider.
  4. Disputes: The Company will not be a party in any disputes between Users and Service Providers. Users must indemnify the Company against any related claims or liabilities.
  5. Cancellation and Refund Policy: Full refunds are available for cancellations or rescheduling made 48 hours or more before the service date. A 50% refund is provided for cancellations or rescheduling made 24 hours prior. No refunds are provided for cancellations on the service day or after the service is completed. In case of service lapses, the Company will assess the situation and provide the best possible resolution, possibly including a refund.

Vastu Consultation

  1. Company Role: Baiyabasa Realty Services Limited (“Company”) connects Users with Vastu consultants, without acting as an agent for either party.
  2. Confidentiality: Users share personal information voluntarily and at their own risk. The Company’s use of this information is governed by its Privacy Policy.
  3. Service Quality: The Company selects reputable Vastu consultants but does not guarantee the quality of their services. Users should address any concerns directly with the Service Provider.
  4. Disputes: The Company will not be a party in any disputes between Users and Vastu consultants. Users must indemnify the Company against any related claims or liabilities.
  5. Effectiveness: The Company is not responsible for any outcomes, whether desired or undesired, resulting from Vastu consultations.
  6. Cancellation and Refund Policy: Full refunds are available for cancellations made before any documents or details (e.g., property layout) are shared. A 50% refund is provided for cancellations after such details are shared. In case of service lapses, the Company will assess the situation and provide the best possible resolution, possibly including a refund.

Legal Assistance

  1. Facilitator Role: Baiyabasa Realty Services Limited (“Company”) acts as an online platform, connecting “Users” with “Service Providers” for legal services. The Company is not an agent for any party, and the transaction between the User and Company is conducted on a principal-to-principal basis.
  2. Definition of Service Provider: A “Service Provider” refers to a company, partnership, proprietorship, or individual engaged in providing legal services. These providers operate independently and are not agents or employees of the Company.
  3. Definition of User: A “User” is any individual, company, partnership, or proprietorship that purchases legal services through the Company’s portal and willingly submits their information.
  4. Confidential Information: Confidential information shared by the User (e.g., name, email address, property address) is provided at their own risk. The Company is not liable for any misuse of this information.
  5. Service Provider Quality: The Company carefully selects its Service Providers based on industry reputation. Although the Company strives to ensure high service quality, it cannot guarantee service quality and is not liable for any shortcomings.
  6. User Responsibility: Users are responsible for verifying and addressing any issues with the Service Provider directly. While the Company will assist in resolving concerns, ultimate responsibility lies with the Service Provider.
  7. Dispute Exemption: The Company is not responsible for and will not be involved in disputes between the User and Service Provider. Users must indemnify the Company for any claims or liabilities arising from such disputes.
  8. Privacy Policy Agreement: By purchasing services through the Company’s portal, Users agree to the Company’s Privacy Policy. The Company reserves the right to modify these terms without prior notice.
  9. Cancellation and Refunds:
    • Cancellations before the verification service begins and after partial documentation is provided are eligible for a 50% refund.
    • Cancellations before any documentation is provided are eligible for a 100% refund.
    • Cancellations after all documentation is provided are not eligible for a refund.
    • In rare cases of service delays or lapses, the Company may offer a refund, with no liability beyond the amount paid by the User.

Relocation Assistance

  1. Facilitator Role: Baiyabasa Realty Services Limited (“Company/We”) partners with Service Providers to offer Packers and Movers services. The Company does not endorse these services and acts solely as a facilitator. Service Providers operate independently and are not agents or employees of the Company.
  2. Definition of Service Provider: A “Service Provider” refers to any entity (company, partnership, proprietorship, or individual) engaged in Packers and Movers services and providing these services to the User based on details shared with the Company.
  3. Definition of User: A “User” refers to any entity (company, partnership, proprietorship, or individual) purchasing Packers and Movers services through the Company’s portal.
  4. Confidential Information: Confidential information shared by the User is done at their own risk. The Company is not liable for any misuse of this information by Service Providers or their representatives.
  5. Service Provider Terms: The Service Provider’s specific terms and conditions govern the services provided. The Company is not liable for any Service Provider’s actions, omissions, or service deficiencies.
  6. User Due Diligence: Users are advised to perform due diligence before engaging with any Service Provider. The Company does not guarantee the genuineness or credibility of Service Providers and is not responsible for any disputes between the User and Service Provider.
  7. Third-Party Offers: The Company is not responsible for any third-party offers availed by the User. Users engage with third-party services at their own risk and responsibility.
  8. Right to Modify: The Company reserves the right to modify, change, or revoke services or offers at any time without notice or liability.
  9. Jurisdiction: Any disputes arising from these terms and conditions are subject to the exclusive jurisdiction of the courts in New Delhi.
  10. Cancellation and Refunds:
    • Cancellations up to 48 hours before service delivery are eligible for a 100% refund.
    • Cancellations within 0-48 hours before service delivery are not eligible for a refund.

    • In cases of a “no-show” by the Service Provider, Users are eligible for a full refund or a reschedule without a fee.
  1. Insurance: Insurance charges are based on the value of goods being moved and are additional to the quoted price unless otherwise specified.
  2. Quotation Changes: Quotation amounts are based on the information provided by the User. Any changes to the item list, movement date, or addresses may result in changes to the quoted amount, and Users must pay any differences.
  3. Promotions and Discounts: Promotions and discounts are subject to the Company’s terms and conditions, which may change without notice.
  4. Dispute Resolution: Disputes between the User and Baiyabasa related to the website or services will be resolved through arbitration in Delhi, governed by the Arbitration & Conciliation Act, 1996.

Tenant Assurance Plan for

Role of Baiyabasa: Baiyabasa Realty Services Limited (“Baiyabasa”) functions as an online platform connecting Property Owners, Potential Tenants, and Service Providers/Brokers. Baiyabasa does not act as an agent for any party; all transactions between them are on a principal-to-principal basis.

Definitions:

  • Landlord/User/Owner: Refers to any Company, Partnership, Proprietorship, or individual legally owning a property and interested in leasing it through Baiyabasa’s portal.
  • Potential Tenant: Any Company, Partnership, Proprietorship, or individual seeking to lease a property listed by the Owner.
  • Service Provider/Broker: A Company, Partnership, Proprietorship, or individual registered with Baiyabasa to assist the Owner in finding a tenant, as per agreed terms.

Mandate: The exclusive rights and terms granted to Baiyabasa by the Owner for leasing out the property.

Guaranteed Tenant Plan (GTP Plan) for Bhubaneswar:

The GTP Plan is available to Property Owners subscribing through Baiyabasa’s website or mobile app in Bhubaneswar, Odisha. Upon subscription, any prior property listings by the Owner will be deactivated during the plan’s duration.

  • No Commission/Brokerage: Owners subscribing to the GTP Plan do not need to pay any commission or brokerage to the Service Provider/Broker.
  • Tenant Matching: The Service Provider/Broker will find a Potential Tenant based on the Owner’s preferences shared during subscription.
  • 28-Day Guarantee: If the property is not leased within 28 days of GTP Plan activation, the Owner is eligible for a full refund of the package cost plus a bonus amount of up to Rs. 7,000, subject to agreed terms.
  • Exclusive Rights: The Owner grants exclusive rights to Baiyabasa and its Service Provider/Broker for 28 days to find a tenant. No refund will be given if the Owner independently leases the property or if the property is unavailable during this period.
  • Tenant Rejection Clause: If the Owner rejects two tenant options provided by the Service Provider/Broker that meet the preferences, the right to a refund is forfeited.
  • Photoshoot Requirement: The Owner may be requested to allow a photoshoot of the property to aid in renting it out.
  • Property Accuracy: The Owner is fully responsible for ensuring the accuracy of the property details listed. Any discrepancies may result in forfeiture of the refund.
  • Cooperation Requirement: The Owner must cooperate with the Service Provider/Broker during property visits. Non-cooperation on three separate occasions will void the refund.
  • Legal Responsibility: The Owner is responsible for conducting legal tenant verification.

Refund Policy:

  • No Service Provider/Broker Assigned: If no Service Provider/Broker is assigned within 5 working days, a 100% refund will be issued.
  • Not Rented on Time: If the property is not rented within the agreed timeline, a 100% refund plus a bonus will be provided, subject to Clause 6(f).
  • No Partial Refunds: No partial refunds will be issued.

Availability: The GTP Plan is currently available only in Bhubaneswar, Odisha.

Confidentiality: Any information shared by the Owner is done voluntarily. The Owner agrees that Baiyabasa, Service Providers/Brokers, and their representatives may contact them via phone, email, or WhatsApp. The use of the Owner’s information is governed by Baiyabasa’s Privacy Policy, which may be updated without prior notice.

Service Quality: Baiyabasa is not liable for service quality issues but will strive to address any concerns raised by the Owner during the plan’s duration.

Tenant Verification: Baiyabasa does not verify or endorse the character or credibility of the tenant. Baiyabasa’s role is limited to facilitating the connection between the Owner and Potential Tenant through the Service Provider/Broker.

Dispute Resolution: Baiyabasa is not responsible for any disputes between the Owner and the Service Provider/Broker or the Owner and the Tenant. The Owner agrees to indemnify Baiyabasa against any claims or liabilities arising from such disputes.

Cancellation Policy:

  • 5-Day Cancellation Window: Owners may cancel the mandate within 5 working days of activation for a full refund, excluding any bonuses. However, if a Service Provider/Broker has already been assigned and communicated to the Owner, the cancellation request will not be accepted.
  • No Cancellations After 5 Days: After the 5-day period, cancellations will not be permitted, and no refunds or bonuses will be issued.
